The Secretary concerned must separate a regular commissioned officer in the pay grade of O-4 no later than the first day of the seventh calendar month beginning after the month in which the President approves the report of the board which failed to select the officer for promotion for the second time when each of the following is true:
- The officer is in the Navy or Marine Corps.
- The officer is not on a list of officers recommended for promotion to the grade of O-5.
- The officer is designated for limited duty.
- The officer will not have eighteen years of service on the first day of the seventh month after the month in which the president approves the report of the board which failed to select the officer for promotion the second time. |
