The Secretary concerned may delay the promotion of a Reserve officer by written notice to the officer before the date the promotion would have originally been effective only if one of the following is true:
- The officer has court martial charges pending.
- The officer is undergoing investigation to determine if disciplinary action will be brought against the officer.
- The officer is under review by a board of inquiry.
- The officer is pending criminal proceedings in a Federal or State court.
- The officer is under review by the Secretary due to substantiated adverse information about the officer. |
