The Service concerned must consider a member's surviving spouse eligible for Overseas Housing Allowance (OHA) Without Dependents through the 365th day after the member dies if each of the following is true:
- The member died while on Active Duty.
- The member's death was in the line of duty.
- The spouse is on Active Duty in a Uniformed Service.
- The member was not killed by the spouse or evidence clearly absolves the spouse of any felonious intent.
- The member and spouse were occupying the same government quarters outside the United States on the day the member entered a deceased status.
- The spouse vacates the government quarters.
- The spouse does not relocate to the United States. |
