The Secretary concerned must consider a member eligible for Overseas Housing Allowance (OHA) With Dependents if each of the following is true:
- The member is eligible or Basic Pay.
- The member is assigned to a Permanent Duty Station outside the United States.
- The member has completed the proper documentation and has been approved for OHA by a designated authority.
- The member is not eligible for Monetary Allowance in Lieu of Transportation-Plus Per Diem.
- One of the following is true:
- The member is in a Regular Component.
- The member is in a Reserve Component and on Active Duty for a period of thirty-one days or more.
- The member is in a Reserve Component and on Active Duty for any number of days in support of a contingency operation.
- The member is neither assigned to nor occupies government quarters.
- The member's spouse is the member's sole dependent.
- The member's spouse occupies private quarters while assigned overseas with the Department of Defense Education Activity as a schoolteacher.
- The member is geographical separated from the spouse by the competent orders.
- The member is not eligible for Basic Allowance for Housing-Differential.
- The member is not eligible for Basic Allowance for Housing With Dependents.
- The member is not on an Educational Leave of Absence. |
