The Service concerned may require a member to take excess leave pending completion of the appellate review of the member's court martial sentence only when each of the following is true:
- The Secretary concerned prescribes in regulations that members who have been sentenced by court-martial to be dismissed or to receive a punitive discharge may be required to take excess leave pending completion of the appellate review.
- The member has been sentenced by court-martial to be dismissed or to receive a punitive discharge.
- The commander exercising court-martial jurisdiction directs that the member take excess leave pending completion of the appellate review. |
