The Secretary concerned must make payment of the death gratuity to the parent of a minor child, including an adoptive parent, as natural guardian if each of the following is true:
- The beneficiary is a minor.
- The death gratuity is $10,000 or less.
- A legal guardian has not been appointed.
- The parent has custody of the minor child.
- The parent will hold the payment for the sole use and benefit of the minor until the minor reaches adulthood.
- The parent will account to the minor for such amount when the minor reaches adulthood.
- The parent will hold the government harmless in the event the minor, when he/she reaches adulthood, brings any legal action challenging the government's payment to the minor's parent. |
