The Secretary concerned must consider a member eligible for Basic Pay for Active Duty if each of the following is true:
- The member is serving on Active Duty.
- The member is not ordered to Active Duty solely to take a physical examination, not incident to being ordered to Active Duty.
- The member is authorized pay and allowances for the period of Active Duty.
- The member is not in a duty status of:
- Absent from duty for more than twenty-four consecutive hours as a result of a disease caused by and immediately following intemperate use of alcoholic liquors or habit forming drugs
- Absent Without Leave in excess of twenty-four hours, unless the absence is excused as unavoidable
- Desertion
- Civil Confinement - In Hands of Civil Authority
- Discharged (former members who are no longer affiliated with a Service)
- Retired (Regular, Reserve, Temporary Disabled Retired List (TDRL))
- Reserve/Guard Member Not On Active Or Inactive Duty
- Excess Leave
- Constructively Absent
- The member is not receiving retired/retainer pay or disability compensation, or has waived his/her retired/retainer pay or disability compensation.
- The member is not assigned by the Service Secretary or designee for employment to perform duties with, and be paid by, another government agency while on Active Duty. |
