The Secretary concerned must consider a member's surviving spouse eligible for Basic Allowance for Housing (BAH) Without Dependents through the 365th day after the member dies if each of the following is true:
- The member died while on Active Duty.
- The member's death was in the line of duty.
- The spouse is on Active Duty in a Uniformed Service.
- The member was not killed by the spouse or the evidence clearly absolves the spouse of any felonious intent.
- The member and spouse were not occupying the same government quarters on the day the member entered the deceased status.
- One of the following is true:
- The member was eligible for BAH Without Dependents on the day the member entered the deceased status.
- The member was occupying government quarters without payment of rental charge on the day the member died. |
