The President of the United States may award a person the Medal of Honor in the name of Congress only when the person's military service is distinguished conspicuously by gallantry and intrepidity at the risk of the person's life, above and beyond the call of duty, and while in an armed force the person was engaged in or served with at least one of the following:
- an action against an enemy of the United States
- military operations involving conflict with an opposing foreign force
- friendly foreign forces engaged in an armed conflict against an opposing armed force in which the United States is not a belligerent party |
